Overview
Welcome to Disha The Label (“Disha The Label,” “we,” “us,” or “our”). We operate the website, online store, and related services (the “Services”). Our Services are hosted by Shopify.
By visiting, interacting with, or purchasing from the Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.

1. Access & Accounts
You represent you are the age of majority in your state or province, and you authorize use by any minor dependents on your devices. You must provide accurate, current, and complete information and keep your credentials secure. You’re responsible for all activity under your account and may not sell/transfer your account.
2. Products & Content
We try to display products accurately; device settings may affect colors/appearance. Descriptions, pricing, availability, and features may change without notice. We may limit quantities, discontinue items, or refuse service at our discretion.
3. Orders & Cancellations
Your order is an offer to buy; we accept only when we charge and confirm. We may cancel or refuse orders (e.g., suspected fraud, stock issues, pricing errors). If we cancel, we’ll contact you using the details you provided.
Purchases are for personal/household use, not resale. Returns/exchanges are governed solely by our Refund Policy.
4. Prices, Taxes & Billing
Prices may change without notice and exclude shipping, taxes, duties, and fees unless stated. The price in your confirmation email applies. You agree to provide current, complete billing details and authorize us (and our processors) to charge your payment method for all amounts due.
5. Shipping, Title & Risk of Loss
Quoted delivery windows are estimates. We are not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we deliver the goods to the carrier (to the extent permitted by law). For international shipments, see Section 6.
7. Intellectual Property
All content on the Services (text, graphics, logos, images, audio/video, design) is owned by Disha The Label or its licensors and protected by law. You may use the Services for personal, non-commercial purposes only. No licenses are granted except as expressly stated.
9. Optional Tools & Third-Party Links
We may provide access to third-party tools and link to third-party sites. They’re provided as is without warranties. Your use is at your risk, and the third party’s terms apply.
10. Relationship with Shopify
We are powered by Shopify, but your purchases are with Disha The Label. Shopify is not a party to your transactions and is not liable for any issues arising from them.
11. Privacy
Your personal information is handled as described in our Privacy Policy and, where applicable, Shopify’s privacy terms. By using the Services, you consent to the processing and transfer of your information as described.
12. SMS & Email Marketing (if enabled)
By opting into marketing, you consent to receive messages at the contact details you provide. Message frequency varies. Message & data rates may apply. Consent isn’t a condition of purchase. See our Privacy Policy for details.
13. Prohibited Uses
You may not use the Services for unlawful, harmful, infringing, or abusive purposes; to send spam; to upload malware; to circumvent security; to scrape/crawl without permission; or to interfere with others’ use.
15. Errors & Availability
At times information may contain errors or omissions (e.g., pricing, shipping, availability). We may correct errors and update or cancel orders if information is inaccurate, including after you submit an order.
16. Warranty Disclaimer
Except as expressly stated by us in writing, the Services and products are provided “as is” and “as available.” We disclaim all implied warranties (merchantability, fitness, non-infringement, etc.) to the maximum extent permitted by law. Some jurisdictions do not allow limitations on implied warranties.
17. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or products shall not exceed the greater of (a) USD $100 or (b) the amount you paid to us for the product(s) giving rise to the claim in the 12 months preceding the event. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill.
18. Indemnification
You will indemnify and hold harmless Disha The Label and our officers, directors, employees, agents, and service providers from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of law/third-party rights.
19. Force Majeure
We are not liable for any delay or failure caused by events beyond our reasonable control, including acts of God, labor disputes, carrier issues, epidemics, embargoes, government actions, or internet/power outages.
20. Termination
We may suspend or terminate access at any time. Sections intended to survive (including IP, UGC license, warranty disclaimer, limits, indemnity, governing law, arbitration, and assignment) survive termination.
21. Assignment
You may not assign or transfer your rights or obligations without our prior written consent. We may assign these Terms without notice.
22. Governing Law; Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Courts located in San Francisco County, California shall have exclusive jurisdiction and venue for any matter not subject to arbitration (Section 23).
23. Dispute Resolution; Arbitration; Class Action Waiver (US)
Informal resolution. Before filing a claim, you agree to email us at hello@dishathelabel.com and attempt to resolve informally for 30 days.
Arbitration. Any dispute not resolved informally will be resolved by binding arbitration administered by JAMS under its Streamlined Rules. Location: San Francisco, CA (or your county if you live in the US). The arbitrator may award individual relief permitted by law.
No class actions. Disputes are only arbitrated on an individual basis; class, consolidated, or representative actions are not permitted.
Opt-out. You may opt out of this arbitration/class-action waiver by emailing hello@dishathelabel.com within 30 days of your first purchase with “Arbitration Opt-Out” and your name, billing address, and order number.
This section does not apply where prohibited by law (e.g., certain consumer rights in Quebec, EU).
24. Entire Agreement; Waiver; Severability
These Terms (plus policies referenced here) are the entire agreement between you and us. Our failure to enforce a provision is not a waiver. If any provision is unenforceable, the remainder remains in effect.
25. Changes to Terms
We may update these Terms by posting a revised version with a new “Last updated” date. Material changes will be notified as required by law. Your continued use after changes means you accept the updated Terms.
